These Terms apply to your access to and use of Strata Action. By creating an account, accepting an invitation or using Strata Action, you agree to these Terms.
Strata Action is operated by 101 Communications / ABN 68 987 871 601 ("we", "us" or "Strata Action").
Strata Action is an online platform designed to assist strata managers, building managers, owners corporations, councils or committees, owners, residents and other authorised users with building and strata-related administration and communication.
We may improve, modify or discontinue features from time to time. Where a material change significantly affects a paid service, we will provide reasonable notice where practicable.
You must provide accurate information, keep your login details secure and only access buildings, information and functions you are authorised to use.
Access is controlled by roles and permissions established for each organisation or building. You must not attempt to access another user's account, another organisation's information or functionality you have not been authorised to use.
You are responsible for activity performed through your account unless caused by a security failure for which we are responsible.
An organisation using Strata Action is responsible for:
Strata Action does not replace professional legal, strata management, accounting or other advice.
In particular, features involving meetings, polls, voting, notices, approvals or records do not guarantee that a process complies with the strata legislation applicable in a particular Australian state or territory.
You must not use Strata Action to:
We may restrict or suspend access where reasonably necessary to protect users, data, the platform or other persons, or where these Terms are materially breached.
You and the relevant organisation retain ownership of information and material entered into Strata Action.
You grant us the limited rights necessary to host, process, back up, transmit and otherwise handle that information for the purpose of providing and supporting Strata Action.
We do not acquire ownership of your building or user data.
Personal information is handled in accordance with our Privacy Policy.
Paid subscriptions are billed at the price and billing period displayed when the subscription is commenced or changed.
Where a free trial is offered, the trial period and any payment arrangements will be disclosed at sign-up. If the trial requires a payment method and is not cancelled before the end of the trial, the selected paid subscription may commence automatically as disclosed during sign-up.
Subscriptions renew for the selected monthly or annual billing period until cancelled.
You may cancel a subscription in accordance with the cancellation options provided through Strata Action. Cancellation ordinarily takes effect at the end of the current paid billing period unless otherwise stated.
We may change subscription prices by giving reasonable advance notice. A price change will not apply retrospectively, and you may cancel before the new price takes effect.
Refunds and other remedies are available where required by the Australian Consumer Law.
We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability.
Strata Action relies on third-party technology, hosting, communications, payment and other service providers. Availability may therefore occasionally be affected by maintenance, internet failures or circumstances outside our reasonable control.
We will take reasonable steps to restore service when problems occur.
Strata Action is an administrative and communication platform. It is not an emergency service.
Do not rely on Strata Action to report or respond to emergencies, immediate threats to safety, fire, medical emergencies, urgent security incidents or other situations requiring immediate assistance. Contact the appropriate emergency service, building manager or other responsible person directly.
Strata Action, including its software, design, branding and original content, is owned by or licensed to us and is protected by Australian intellectual property laws.
You may use Strata Action only for its intended purpose. You must not copy, reproduce, sell, reverse engineer or commercially exploit the platform except where permitted by law or with our written permission.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of Strata Action, loss caused by information or decisions supplied by users or organisations, or circumstances outside our reasonable control.
Where the law permits liability for services to be limited, our liability may be limited to supplying the services again or paying the reasonable cost of having them supplied again.
You may stop using Strata Action at any time.
An organisation may remove a user's access to its building or organisation. We may suspend or terminate access where reasonably necessary because of non-payment, serious or repeated breaches of these Terms, unlawful activity, security risks or discontinuation of the service.
Where reasonable, we will provide notice and an opportunity to remedy the issue before terminating a paid service.
We may update these Terms to reflect changes to Strata Action, our business or applicable law.
If a change materially affects your rights or obligations, we will provide reasonable notice before it takes effect. Continued use after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Western Australia, Australia, and applicable Commonwealth laws.
